Q & A

1) Q:   How do I know if I am a member of the prospective Class in the YouTube copyright infringement class action?

A:   We believe that if you are an individual or entity that owns copyrights or has exclusive rights to intellectual property protected under state law, where that property has been misappropriated and exploited by defendants YouTube and Google, without authorization or permission, through www.youtube.com, on or after December 15, 2005, for their own gain without payment or license to you and were injured thereby, you may be eligible to become part of the class of individuals or entities for whom we are trying to seek an injunction against future infringement and possibly a monetary recovery.

2) Q:   What is a class action?

A:   A class action is a type of lawsuit that allows a representative or named plaintiff to sue a defendant or defendants on behalf of other people (the "Class") who have suffered the same type of harm. A class action is filed when, among other reasons, the issues in a case apply to so many people that it is not practical for all of them to file their own individual actions.

3) Q:   What are the benefits of a copyright infringement class action?

A:   A copyright infringement class action provides the thousands of individuals and entities that were injured as a result of copyright infringement the ability to litigate on a level playing field against large, well-funded corporations, which have huge resources to spend on defending claims brought by individuals seeking to hold them accountable for the alleged copyright violations. A class action allows many people who would never have brought an individual action to rely on a lead plaintiff to prosecute the case for them.

4) Q:   What is a class period?

A:   A class period is a specific period of time which starts on the day that a company first committed copyright infringement and ends on the day that the last copyright violation occurs. In this case, the class period extends from December 15, 2005 through the present until YouTube’s illegal actions cease.

5) Q:   What is a lead plaintiff?

A:   A lead plaintiff is a person or entity that files an action on behalf of similarly situated persons or entities to represent the interests of all potential class members.

6) Q:   I live outside the United States. Can I still participate?

A:   We believe that yes, as long as you own copyrights, or have exclusive rights of the intellectual property protected under state law, that were misappropriated and exploited by defendants through www.youtube.com, on or after December 15, 2005, and were injured thereby, and are not otherwise excluded from the Class, then you can participate in the class action.
